In 2008, lawyers for US mafia boss Vincent Basciano asked for the judge in his trial to be replaced as they felt Brooklyn judge Nicholas Garaufis could not give him a fair hearing because Basciano had been accused of plotting to kill him.

"There is a serious question whether Garaufis has personal animosity towards a person who has allegedly sought to kill him," a lawyer said.

According to an Italian small businesses and shopkeepers' association, the Mafia bucked the recession in 2009 and raised profits by almost eight per cent.

"Mafia Inc. is reinforcing its position as the number one Italian company," said the report.
